1. Entitlement to Use Certification Mark

The Certificate Holder granted with the Certificate of Approval (F.7) is entitled to use the Certification Mark given in the website.

2. Terms and Conditions for Use of Certification Mark

2.1 Traceability

Use of Mark should be carried out in such a manner, that it ensures traceability back to QMS International Certifications Pty Ltd (QMSI). Our Logo itself includes full name of our Certification Body.

2.2 No Ambiguity

Certified client should ensure that there is no ambiguity, in the mark or accompanying text, as to what has been certified and that QMSI has granted the certification.

2.3 Product Packaging Restriction

The Certification Mark shall not under any circumstances be used on a product or product packaging seen by the consumer or in any other way that may imply that the product(s) itself has been certified by QMSI.

FSMS Specific: QMSI don't authorize the use of FSMS certification mark on the product nor the product packaging. Product packaging cover all product packaging, both primary packaging (which contains the product) and any outer or secondary packaging.
2.4 Laboratory Reports

QMSI don't permit its marks to be applied by certified clients to laboratory test, calibration or inspection reports or certificates.

2.5 Product Packaging Statements

QMSI have established following rules governing the use of any statement on Product Packaging (Product Packaging is considered as that which can be removed without the product disintegrating or being damaged, ex. external corrugated/wooden packing, printed duplex packing) or in Accompanying Information (Accompanying Information is considered as separately available or easily detachable, ex. leaflet, brochure etc.) that the certified client has a certified management system.

Type labels or identification plates are considered as part of the product. Statement on Product Packaging shall in no way imply that the product, process or service provided by client is certified by QMSI. Statement should clearly imply that the Management System is certified.

Statement on Product Packaging or in Accompanying Information shall include reference to:

  • a. identification (e.g. brand or name) of the certified client;
  • b. the type of management system (e.g. quality, environment) and the applicable standard;
  • c. QMSI
Example:

Quality Management System of ABC Ltd. is certified against ISO 9001:2015 by QMS International Certifications Pty Ltd.

FSMS Specific: QMSI don't permit the use of any statement on product packaging that the client has a certified FSMS. This includes all product packaging, both primary packaging (which contains the product) and any outer or secondary packaging.

3. Client obligations through Legally Enforceable Arrangements

QMSI through a legally enforceable arrangements (F.1) require that the certified client:

3.1

conforms to QMSI requirements when making reference to its certification status in communication media such as the internet, brochures or advertising or other documents;

3.2

does not make or permit any misleading statement regarding its certification;

3.3

does not use or permit the use of a certification document or any part thereof in misleading manner;

3.4

upon withdrawal of its certification, discontinues its use of all advertising matter that contains a reference to certification, as directed by QMSI;

3.5

amend all the advertising matter when the scope of certification has been reduced;

3.6

does not allow reference to its management system certification to be used in such a way as to imply that the QMSI has certified a product (including service) or process;

3.7

does not imply that the certification applies to activities and sites that are outside the scope of certification;

3.8

does not use its certification in such a manner that would bring the QMSI and/or certification system into disrepute and lose public trust;

3.9

The certified organisation shall not display the certification mark on buildings, organisational flags and vehicles except in publicity material like part of a large advertisement.

4. Control and Actions for Misuse

QMSI will exercise proper control of ownership and will take action to deal with incorrect references or misleading use of certification documents, marks or audit reports as per details given below:

4(a) Intentional Misuse

Should intentional misuse of Certificates or Marks occur then a major CAR shall be raised and an appropriate action may be taken which may include:

  • Withdrawal of certificate
  • Information of withdrawal to customers and competitors
  • Publication of such actions in News papers and,
  • If necessary, other legal actions
4(b) Unintentional Misuse

Should an unintentional misuse of Certificates or Marks occur then dependent upon the severity and extent of misuse an appropriately graded CAR shall be raised.

Should a minor CAR be raised then it must be closed out within three (3) months or the CAR shall be upgraded as 'Major'.

5. Compliance Monitoring

Adherence to the requirements of these procedures shall be examined during each visit to the client.

Instances of non-fulfilment of these requirements may also be discovered by other means and may result in the issuance of a CAR.
